This article examines Tajikistan\u2019s policy toward Afghan refugees in the context of the gap between formal international obligations and their practical implementation. Despite ratifying the 1951 Refugee Convention and adopting national refugee legislation, the actual situation of Afghan refugees in Tajikistan is characterized by substantial restrictions: geographical limitations on residence, limited access to healthcare and education, and instances of non-refoulement violations. Based on fieldwork conducted in 2024, including interviews with refugees, government officials, and representatives of international organizations, as well as legislative analysis, the study identifies a pattern of selective compliance with international norms: the state fulfills obligations that do not require significant resources (status determination procedures) while violating those that entail financial costs (welfare provision) or involve security and control concerns (the principle of non-refoulement). The research challenges the assumption of a direct relationship between treaty ratification and refugee protection quality, highlighting the necessity of accounting for structural conditions\u2014security priorities and weak international oversight.<\/p>\n
